Phoenix, AZ (October 7, 2024): Citizens prosecuted for alleged crimes have the right to due process, free from bias in the judiciary, jury, or prosecution. However, a pattern of potentially questionable conduct by the Maricopa County Attorney’s Office raises serious concerns about the fairness of the justice system in Arizona.
Courts in Maricopa County have faced scrutiny for inappropriate behavior, including mocking and ridiculing individuals and circulating emails and memes containing offensive content. Despite investigations, these matters have been dismissed, and records sealed from public view, raising questions about transparency and accountability. ABC15 Investigations has published lengthy investigation on the Maricopa County Attorney manufacturing crimes (linked here and here).
One case highlighting these concerns is that of Sanjay Gohel, (1 CA CR 13-0373 PRPC) a local convenience store owner of East Indian heritage. In his prosecution, the State allegedly relied on questionable testimony to secure a debatable conviction, resulting in a life sentence without the possibility of release.
This case aligns with a broader pattern of potentially troubling behavior by the Maricopa County Attorney’s Office. Reports indicate a history of targeting minorities and manufacturing evidence, raising concerns about racial bias within the system. (linked here and here; see also here and here)
Due to Arizona law, Sanjay has limited avenues for appeal or review of his case, further underscoring the need for greater oversight and accountability within the Arizona justice system.
“The motto of the Maricopa County Attorney’s Office is ‘Let Justice Be Done’,” states George Kayer CEO of Cadmus Publishing “This same justice must be afforded to all citizens, including those who may have been victims of prosecutorial misconduct or bias, also I ask all Arizonans to pay attention to Prop 137 giving lifetime appointments to Superior Court judges, if passed this would effectively block any meaningful reforms in Arizona’s flawed justice system.
Public awareness and engagement are crucial to ensuring fairness and justice for all. Citizens are encouraged to contact their elected officials to demand transparency and accountability within the Maricopa County justice system.
