Urian Young was a young man who purchased a gun for self-protection. He had that weapon when a gang banger showed up to his house and Mr. Young was forced to defend himself. This is Ari case CR 1994-10928
For this crime, Mr. Young was arrested and charged with first degree murder During the investigation, it was discovered that the weapon Mr. Young legally purchased had a sinister past, where one of its previous owners had used the weapon in a different homicide. Due to this Mr. Young was charged with a second murder. This is case CR 1995-00530.
During the trial for the 1994 case Mr. Young was convicted. He was a first-time offender and eligible for a like life sentence with the possibility of parole after serving 25 years. There are many ineffective assistance of counsel issues, Young insisted he be provided the opportunity to apologize and his attorney failed him. Numerous research studies in the USA and UK show that defendants who apologize receive a lesser sentence. However, that is not where the controversy comes in.
In the 1995 case, Mr. Young was acquitted by a jury and should not have any sentence of prison levied against him. However, Judge Silvia Arrelano held a sentencing hearing and announced case CR 1995-00530. She proceeded during this hearing to sentence Mr. Young to life without the possibility of parole. This case was fully acquitted and should have been pronounced as such. Instead, Mr. Y sits in an Arizona prison with no chance of going home unless someone takes up his cause.
This wrongful sentencing issue was recently discovered and needs to be fully litigated. An invalid sentence cannot stand. While Mr. Young understands he had a valid conviction for the 1994 case, without the Judge’s obvious misunderstanding of the acquittal of the 1995 case, he would have been seen as a first-time offender and eligible for parole after serving 25 years. Instead, he sits in prison for a murder he was acquitted of.
